Terms of Service

These terms set the agreement between you and Mic Press when you use this site. They are written plainly, and we mean them straightforwardly.

i.Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of micpress.com and the services offered through it (together, the “Site”), operated by Mic Press, LLC, a Delaware limited liability company based in New York, New York. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Purchases made through the Site are also governed by our Terms of Sale, and your privacy is governed by our Privacy Policy and Cookie Policy. Where those documents address a subject more specifically, they control for that subject.

ii.Use of the site

You may use the Site for your own lawful, personal, non-commercial purposes — to read our essays, learn about our titles, subscribe to the newsletter, submit work, and buy books. You agree not to misuse the Site: no attempting to breach its security, no scraping or harvesting at scale, no introducing malware, no interfering with its operation, and no using it to infringe the rights of others or to break the law.

You are responsible for any information you submit and for keeping your account credentials, if any, confidential. We may suspend or end access for anyone who violates these Terms or uses the Site in a way that harms Mic Press, our authors, or other readers.

iii.Intellectual property

The Site and its contents — text, essays, book descriptions, cover artwork, photography, typography, design, code, and the Mic Press name and marks — are owned by Mic Press or our authors and licensors, and are protected by copyright, trademark, and other laws. Except for the limited personal use these Terms allow, you may not copy, reproduce, republish, distribute, adapt, or create derivative works from any part of the Site without our prior written permission.

You may quote briefly from our published essays for the purposes of commentary, criticism, or news reporting, with attribution to the author and to Mic Press. For anything beyond that — reprinting, translation, or commercial reuse — please see our Rights & Permissions page and write to rights@micpress.com.

iv.Manuscript submissions

We welcome submissions, and we read them with care. When you send us a manuscript, proposal, or other materials, you confirm that the work is your own, that you have the right to share it, and that doing so does not breach any other agreement or infringe anyone’s rights. You retain all copyright and ownership in your work.

Sending us a submission does not create a publishing agreement, an obligation to publish, or any partnership; a publishing relationship arises only under a separate written contract signed by both parties. You grant us a limited, non-exclusive license to read, evaluate, and internally circulate your submission for the purpose of considering it for the list. Because we read widely, you acknowledge that we may already be developing or may later develop work that resembles yours; this clause does not affect any rights you hold in your own material.

Please do not send confidential information you are unwilling to share for evaluation, and please keep a copy of anything you submit — we cannot guarantee the return of materials.

v.Third-party links and services

The Site links to and relies on third-party services — among them Stripe for payments, Buttondown for the newsletter, and the retailers through which our books are sold. We do not control these services and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms, which we encourage you to read.

vi.Disclaimers

The Site and its contents are provided “as is” and “as available.” The essays and other writing we publish reflect the views of their authors and are offered for thought and discussion, not as professional, legal, financial, or investment advice. While we work carefully, we do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete or current.

To the fullest extent permitted by law, Mic Press disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

vii.Limitation of liability

To the fullest extent permitted by law, Mic Press and its members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our total liability to you for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100), or, where the claim relates to a purchase, the amount you paid for the items concerned. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.

viii.Indemnification

You agree to indemnify and hold harmless Mic Press and its members, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your infringement of the rights of any third party.

ix.Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts. Nothing here deprives a consumer of the protection of mandatory laws in their place of residence.

x.Changes and contact

We may revise these Terms from time to time. When we do, we will update the date at the top of this page, and continued use of the Site after a change means you accept the revised Terms. If any provision is found unenforceable, the remaining provisions stay in force.
