We are a publisher; we take copyright seriously, ours and everyone else’s. This page sets out how to report an infringement and how the process works.
i.Our commitment
Mic Press, LLC respects the intellectual property of others and expects users of micpress.com to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we respond to clear notices of alleged copyright infringement involving material on our site.
If you believe that content on micpress.com infringes a copyright you own or control, you may send us a notice using the procedure below. If material you posted or submitted was removed and you believe that was a mistake, you may send a counter-notice.
ii.Filing a takedown notice
To be effective, a notice of claimed infringement must be in writing and provided to our Designated Agent (below). It must include substantially the following, as required by 17 U.S.C. § 512(c)(3):
1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf. 2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notice, a representative list. 3. Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to let us locate it — ideally the exact URL on micpress.com.
4. Information reasonably sufficient to permit us to contact you: your name, mailing address, telephone number, and email address. 5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. 6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
iii.Designated agent

iv.What happens next
On receiving a valid notice, we will act expeditiously to remove or disable access to the material identified, and we will take reasonable steps to notify the user who provided it, where applicable. Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.
v.Counter-notice
If you believe that material of yours was removed or disabled by mistake or misidentification, you may send a written counter-notice to our Designated Agent containing substantially the following: your physical or electronic signature; identification of the material that was removed and the location at which it appeared before removal; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number.
Your counter-notice must also include a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any district in which Mic Press may be found), and that you will accept service of process from the person who filed the original notice or that person’s agent. If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the activity.
vi.Repeat infringers
It is our policy, in appropriate circumstances, to disable access for and terminate the accounts of users who are found to be repeat infringers. We also reserve the right to remove any material that, in our reasonable judgment, infringes the rights of others or violates our Terms of Service, with or without notice.
